Condo/HOA Board Fatigue: The Struggle Is Real

In this week's tip, we address the very understandable feeling among some board members that they didn't sign up to oversee a community during a pandemic, and they want to step away.
We're hearing from readers and our experts that board members are, at the very least, grumbling about wanting to resign because they don't want to handle the challenges that have come with COVID-19. John Richards, founder of Salt Lake City-based Richards Law, which represents at least 3,000 condo and planned-unit developments throughout Utah, experienced this situation literally the morning we contacted him.
"This issue ties into the consequences of postponing annual meetings where you have your elections," he says. "I've had a couple of instances, including one today, where we have board fatigue. In these cases, I know COVID-19 is the straw that's breaking the camel's back. These board members aren't going to run for reelection, and they're asking, 'Can we resign?'
"I haven't seen a lot of it," he admits. "But the funny thing about the one this morning is that it's a five-person board, and they wanted to know whether, because we postponed their annual meeting for 45 days, they could resign and appoint a new board—every single one of them.
"I told them that's not a good idea," explains Richards. "I don't think their request came from the pandemic alone. They have a private water system, and they've been under scrutiny from the state for the quality of their water. We just completed a project to address the problem. And I believe their thinking is, 'Let's get new blood in here.'"
The other experts we checked in with haven't run into this issue. But they would encourage wobbly board members to firm up, at least for a short time.
