COVID-19: Condos/HOAs Slowly Wade Into Pool Openings

In week's tip, we address a particularly confusing issue during the pandemic: Pools. You wouldn't believe the number of questions we've gotten from readers and webinar participants that have touched on every aspect imaginable about how and when to open pools!
Let's be frank: Condos and HOAs are all over the board when it comes to when and how to open their pools.
"For the most part, all the indoor pools are still closed for my clients—that's usually the high rises," reported Alex Noland, CCAL, founder of Noland Law in San Francisco, which represents about 100 community associations throughout California. This was in early June. He added, "Outdoor pools can be open now statewide, but there are also county-specific rules, and some are more restrictive. To the extent you can reopen, there are a lot of requirements for signage and other things you have to put in place and keep in place while it's open."
Noland notes his clients range from areas with more COVID-19 cases, such as big California cities, to less-dense locales with fewer cases, such as Lake Tahoe, California. "Here in San Francisco, we're in phase 2B," he says. "Phase three is expected to be in mid-August for San Francisco, and that's when restaurants will open. If you're in Lake Tahoe, you can be in restaurants now. So I have to track all the various areas' restrictions.
"Some of my clients are reopening their pools and not understanding what the requirements are for them to do that," adds Noland. "For instance, in San Francisco, you can't even open your pool. In San Mateo, associations must have a pool monitor enforcing social-distancing rules.
"In Santa Clara, there can be only one person in the pool per 300 square feet of pool space, so associations have to create a reservation system for residents to be able to use the pool," he continues. "Then, are you just putting a sign up for reservations and working on the honor system or are you making residents go to the management office? Boards aren't always understanding what's allowed in their county and complying with those rules."
It's those rules that tip the scales on whether to open for the clients Todd J. Billy, an attorney at The Community Association Lawyers in St. Louis, who is licensed in Missouri and Illinois and has more than 1,000 active condo and HOA clients.
