Happy 4th! Now Enough with the Fireworks in the Condo/HOA!

HOAleader.com - Tip of the Week - July 2, 2021

=================================================================

In this week's tip, we address an issue that's timely right this second and that you may want to put on your agenda now to discuss before next year's 4th of July holiday.

First, happy 4th! Have fun and be safe out there!

Second, let's talk about fireworks, which you may even be hearing go off as you're reading this article.

Who doesn't love fireworks?

Actually, plenty of people. Veterans who suffer from post-traumatic stress disorder often struggle when others celebrate with fireworks. And more dogs go missing July 4 and 5 after panicking in response to fireworks.

What's more, fireworks can be dangerous. According to the National Fire Protection Association, an estimated 19,500 fires started by fireworks were reported to U.S. fire departments in 2018, causing five civilian deaths, 46 civilian injuries, and $105 million in direct property damage.

Should your condo/HOA attempt to ban their use for any or all of those reasons? Our experts say there are pros and cons.

Many communities in Oregon are already on top of this issue. “Being in a high fire-risk area, this is something we go through every summer,” reports Katie Anderson, PCAM, AMS, CMCA, the founding owner of Aperion Management in Bend, which manages nearly 70 condo, HOA, and townhome associations throughout Oregon. “Wildfires pretty much devastated many areas in Oregon last year, so that's something everybody takes seriously.

“In our area, HOAs can ban them,” she explains. “For many communities, their use-restriction language allows them that ability for health and safety reasons to implement additional rules and regulations.

“Where we see these are mostly in the condos, not as much in single-family communities, where there may not be common areas where fireworks may be set off,” adds Anderson. “We represent a handful of communities in more at-risk areas, such as resorts neighboring a national forest. In those, there are outright bans.

Other communities ban what some call “safe and sane” fireworks. Yet others say it's none of the condo or HOA's business. Read more in our new article:

Did This Decision Require a Condo Owner Vote? (And Can a Board Meet and Vote on WhatsApp?)

An HOAleader.com reader asks, "I recently learned that the board pushed for a common-element area in my floor to be used to store bicycles. While the building is in need of a bike-storage space, I find that keeping the bikes in the middle of a common-element area devalues the property of the unit owners.
