Florida Condo Dives into Vaccine Mandate Controversy: Should You?

If your board has been considering a rule requiring that the companies and people you work with show proof of vaccination, you'll want to read this week's tip.

It comes in response to reports Miami Beach's Continuum condo touting their status as the first condo association in South Florida to enforce a mandatory vaccination requirement among its employees and third-party contractors.

The Continuum includes several associations, including an overarching association, and it's the board of that umbrella entity that voted to implement this mandate, reports Rishi Idnani, managing director of the Continuum at Marquis Association Management. The vote was unanimous among the five board members.

"We're piloting, with the North Tower, a requirement that a copy of the Centers for Disease Control vaccination card be provided by vendors, such as contractors doing buildout for a new unit or plumbers doing work," says Idnani, whose management company also has a vaccine requirement for its employees. "We save it to their vendor profile like we do with their certificate of insurance."

Has there been any pushback? "Not at all," he states. "We've had an overwhelming interest in vaccination support, and we started doing vaccinations on site. We consider this really more of an access rule, much like if these contractors couldn't validate that they have a general liability policy to work on site."

Any chance some contractors are playing along but providing fake cards to stay on the job? "Everyone knows about the fact that people can get fake cards, but we're doing the best we can to ensure the cards look as real as they can be," says Idnani. "No one on my staff is employed by the CDC or the government. But they haven't come across any that don't look right; the cards seem to have been on the right card stock material and in the right font. But our staff have been advised and trained that if they see anything that doesn't look appropriate, she should ask us about it."

This policy was implemented after input from the association's lawyer. "We routinely check with legal counsel on issues like this," says Idnani. "Before the board adopted this policy, it was closely examined by the association's lawyer to ensure it complied with state and local ordinances. If we hear anything different, we'll regroup and restrategize to follow the appropriate law."
