HOAleader Video: When Police Seem Disinterested
in Alleged Drug Sales in Your HOA
HOAleader.com - Tip of the Week - February 18, 2022
In this month's HOAleader.com video, we get some answers for an HOAleader.com reader who's on the board of a 30-unit community and believes their neighbor and the neighbor's live-in boyfriend are dealing drugs both inside and outside the gates of the community.
Our reader says the local police and narcotics squads have been notified, but there's been no good response. Law enforcement also doesn't seem interested in the video our board member has compiled, spanning about two months of activity.
Click on the arrow below to hear a short clip in which two of HOAleader.com's experts—Matthew Zifrony of Florida and Jasmine Hale of California—discuss how a condo or HOA board can evaluate whether this is an issue they need to deal with or one that's better left to the board member to deal with as a
homeowner.
Zifrony advises homeowners and condo associations at Tripp Scott, a Ft. Lauderdale law firm. He has also served as the president of a 3,000-home association. Hale is a partner at Berding & Weil, based in Walnut Creek, Calif. She advises condos and HOAs throughout California.

And don't miss the
extended video article with these two pros where they discuss what this board should in this particular situation and what it can do if the local police department isn't stepping in. Is there something the board needs to address because it might affect safety within the community? Or is this an issue they should absolutely, positively leave to law enforcement?

An HOAleader.com reader asks, "Our bylaws read, 'The affairs of the association shall be managed and governed by a board of directors composed of not less than 3 not more than 33 members.' The term limit is one year. Each year, the HOA board increases or decreases based on the number of candidates for the board. As long as no more than 33 candidates apply, everyone is voted in. Can this
possibly be correct?"
An HOAleader.com reader asks: "Aside from the current state and county COVID-19 restrictions and rules, can the board make our own more-strict rules? This is a 55+ community, so we want to be extra careful. Can we keep a record of resident vax status? When our outdoor pool opens in the spring, can we prevent residents and guests who aren't vaccinated from using the pool and patio area
around the pool?"
An HOAleader.com reader asks: "I just joined our HOA board as secretary. (We have 17 units in our complex. We're located in Southern California in Los Angeles County). Our current HOA management company didn't send out the mailed notification of the board meeting to our HOA members, so we had low voter turnout to our HOA members' meeting. (We had only eight units show up. Two HOA members
were there by accident because they were walking their dog. Our meeting was outside.)..."
