Condo/HOA Safety In the Wake of Murder, Injury of Management Staffers

In this week's tip, we share very tragic news and begin to try to make sense of it.

On Aug. 24, three people—two of whom were employees of a condo management company—were shot at the 1280 West Condo Association in Midtown Atlanta. Only two survived. News reports have identified the alleged shooter, Raissa Kengne, as a disgruntled resident.

Murdered were the condo's manager, Michael Shinners of Beacon Management Services, and Wesley Freeman, Kengne's former manager at an accounting firm. The condo's chief building engineer, Mike Horne, also of Beacon, was injured. Shinners and Horne were found in the condo's management office.

As of Sept. 8, Horne was reportedly removed from a ventilator and is recovering.

Kengne had reportedly filed a 407-page federal lawsuit against the condo association, its managers, a neighbor, and a number of other defendants. She accused them of allowing a former employer to break into her home, along with a number of other conspiracies. She was arrested at Atlanta's airport.

"This is a very scary time," states Brad van Rooyen, founder and senior member of Tampa, Fla.-based HomeRiver Group and its national specialist for community association management, which operates more than 230 association in three states. "For the last few years, it seems like we're just dealing with more and more crazy. It's a very different world than when I first got into community association management."

There's still much to learn about this incident. But it raises an important question for condo and HOA board members: Are you doing all you can to keep your manager safe and to lower the temperature in your community?

"It's a challenge because there's a level of trying to predict the unfathomable, and the tragedy can come from outside the community, too," states Todd J. Billy, CCAL, an attorney at The Community Association Lawyers in St. Louis, who is licensed in Missouri and Illinois and has more than 1,000 active condo and HOA clients.

Two of our managers are incredibly saddened by the loss of their peers. "It's tragic and sad," says Alana Ashby, CEO and vice president of Association Management Inc. in Meridian, Idaho, which manages about 160 community associations in the state. "I read a statement by the manager's wife as well, and it sounds like he was an amazing person."
