In this week's tip, we debate the latest sharing trend—that of renting out pool time through an app called Swimply. But spoiler alert: That's not the only way owners are cashing in on their property that you may need to be aware of.

"I haven't previously heard about this," reports Jasmine F. Hale, CCAL, a partner at Berding & Weil based in Walnut Creek, Calif., who advises condos and HOAs throughout California. "I guess there's no end to the creative ways people can try to monetize their home."

Marshal Granor, CCAL, managing partner at Granor & Granor PC in Horsham, Pa., who is not only a community association lawyer but is also the former owner of a community association management company, actually saw Swimply's funding pitch.

"I like the TV show Shark Tank, and Swimply was on there," he explains. "They said it was the most stupid idea they'd heard, and they didn't give it money."

Patricia A. Ayars, founder of Ayars & Associates in Glastonbury, Conn., who has been practicing association law for more than 30 years, has experienced the app's use first hand. "My neighbor is doing Swimply," she says. "I'm not part of a community association, and I have no business saying anything except when they violate the noise ordinance or are driving drunk down the street. Because not only do they rent out their pool, but they also allow people to come out to their property with their ATVs."
