You could never face a recall vote, right?
In this week's tip, we help you see clearly whether that assumption is sound.
More and more board members are surprised to find that, despite their good-faith efforts to run their condo or HOA with care and thought, their owners are threatening or actually instigating recall votes.
In fact, one of our experts had consultations about recalls with two different HOA boards in the same week in June. “I'm seeing this issue more and more due to costs, votes, insurance, damage, or whatever,” says David Firmin, managing partner at Altitude Community Law PC in Lakewood, Colo., with satellite offices in Loveland, Colorado Springs, Durango, and Frisco.

Firmin's partner, Melissa Garcia, a shareholder at Altitude Community Law PC in Lakewood, Colo., who provides advice and counsel to Colorado associations in all areas of community association law, says her lawyers firmwide are handling more recall issues for clients.
“I never saw recalls probably the first 10 years I was practicing,” she says. “In the last five years, I've seen a number of them. It doesn't mean they lead to the actual recall of the board. It just means there are more and more people—I think starting from COVID and moneywise; whenever they're upset about things that hit their pocket—who'll automatically blame the board or try to recall the board.”
