HOA Board Recalls: How You Can Win Without Resorting to a Recall

If you have the right language in your condo or homeowners
association governing documents, you may be able to remove
problematic board members quickly and easily--without a recall
fight.

For this week's tip, we spoke with Amy H. Bray, a partner at
Andersen, Tate & Carr PC in Lawrenceville, Ga., who represents
condo and homeowners associations.

Amy described a situation where an HOA board member's improper
behavior prompted the rest of the board to seek her ouster. Amy
was brought in to begin the recall process.

Amy told us, "We sat down with the board member and said, 'We're
going to go through the recall process, and if you want to resign,
we'll give you that option,'

"The board member consulted with a lawyer and told the board, 'I
think I'm going to resign.'" But in the end, she never followed
through.

Luckily, the governing documents stated that board members with
a certain number of unexcused absences were eligible for removal.
"We had great documents to start with," Amy told us. "Not all
bylaws have that language."

When the board member failed to show up at several meetings, the
board used its power to remove her without the headache of a
recall.
