"Do Your Chores or Pay Up!" Can You Say This to Owners in Your HOA?

In this week's tip, we discuss a question that an HOAleader.com member
posted on our discussion forum on an issue that's all too common, especially
at small, self-managed HOAs: When we "assign" work to owners, if they don't
do it, can we charge them to have it done?

"I've seen this situation with an association that had been created years
and years ago," says Duane McPherson, president of corporate development
for CiraConnect, which provides management companies, developers, and
large-scale self-managed associations with a cloud based software
solution and back-office shared service. "They developed a policy. It was X
amount of dollars per year for maintenance fees per member. But they also
provided the opportunity for members to work that off, and many did. But it
was a nightmare trying to keep track of who did what. They've done it for
years, and there's a lot of acrimony."

There's acrimony because this practice triggers many challenges:

* You need every owner to agree. "You'd have to determine that the
association would specifically be offering owners to provide in-kind
service that they could chose to do or not to do and state that if owners chose
not to do it, there would be a cost," says Debra A. Warren, CMCA, CCAM, PCAM,
senior vice president at Dallas-based Associa(r), a community association
management company with offices throughout the United States, Canada, and
Mexico. "If you don't have cooperation from everybody, you need to hire
someone and have everybody pay their proportionate share."

* You probably don't have the authority to insist owners do this work. Why
would you need every owner to agree? Because you can't force them to do this
work.
