In this week’s tip, we discuss the challenges you’ll face if you attempt to ban firearms from your HOA property.

When you think of the risk of being an HOA board member, the first thing that probably pops you’re your mind is an owner suing you personally for some supposedly outrageous act you’ve committed.

There can be personal risks, as well. The events of September 6, 2012, show how true that is. At a church in Louisville on that day, 73-year-old David Merritt, president of the Spring Creek Homeowners Association, and Marvin Fisher, the association’s former president, were shot by a resident, according to Wave3 News. Neither man survived.

The alleged killer, Mahmoud Hindi, died of an apparent suicide in jail while awaiting trial. Neighbors say that at the time of the murders, Hindi was in a dispute with his HOA over a driveway and fence he’d installed that his HOA claimed were unapproved.

Thankfully, such tragedies are rare. But people seem angrier than ever before in this country. And gun sales continue to increase. In fact, more guns were sold in December 2015, according to a June 2016 report in The New York Times, than almost any other month in nearly two decades. That growth was part of a continuing a pattern of spikes in sales after terrorist attacks and calls for stricter gun-buying laws, according to federal data.

Is the answer for you to prohibit guns at your HOA?

Gun rights are protected under the Second Amendment of the U.S. Constitution. However, the right to possess a handgun in the home for self-protection, as provided by District of Columbia v. Heller in 2008, is so far the only absolute right to a firearm the U.S. Supreme Court has identified. Since that decision, the court has declined to hear gun-legislation case after case, leaving open many questions about the scope of the Second Amendment.

Based on Heller, we know you’ll absolutely not be able to tell homeowners they can’t have a handgun in their own home.
