6 Things to Ask Potential HOA Board Appointees

In this week’s tip, we help you prepare for that rare unicorn sighting.
We’re kidding. What we’re actually referring to is the possibility that
you’ll have to fill a board seat by appointment, and you’ll have several
willing candidates. What to do?
The easiest solution is to appoint someone you know agrees with your vision
for your HOA.
Maybe you’ve been in a three-person majority, and one of the two dissident
members has stepped away from the board. It’d make your life much easier not
to have to hear two people disagreeing with you all the time, right? So maybe
it’s best to fill the post with someone who thinks like you do?
Maybe not, says Jeff B. Smith, an associate attorney who specializes in
representing associations in covenant enforcement and litigation
matters at Hindman Sanchez in Lakewood, Colo.
“I think it’s good to have those factions and to have different viewpoints
represented on the board,” he says. “That can lead to division. But it’s good
to have division on the board. Otherwise it’s four or five people doing what
they want to do.”
A better approach is to conduct smart due diligence to find a qualified,
insightful candidate who can bring new views and ideas to your association.
You can do that by asking thoughtful questions of potential appointees to
determine their skills and goals.
OK, we’ll interrupt this article to make an admission: We sort of threw our
experts with this question because, apparently, it envisions an event as
rare as hens’ teeth.
“Most of the time, we’re begging people to be on the board,” reports Amy
Tinetti, a shareholder at Hughes Gill Cochrane Tinetti P.C., which
represents hundreds of condos and HOAs in Northern California. “So this
idea of having people to choose from and being able to vet them and figure out
who knows more is a foreign concept.
“In fact, I went to a meeting last night where they were begging people to
serve,” adds Tinetti. “This is not the norm in most of the associations I deal
with.”
Ditto for Smith. “It’s rare to me for a board to have a lot of choices on whom to
appoint,” he says. “Generally you’re taking whoever comes along.”
Those experts make a fair point. But it’s best to be prepared even for rare

Florida On Verge of Going After Corrupt Condo and HOA Boards
In this week's tip, we discuss a potential law in Florida a bill that would
impose criminal penalties on condominium violations such as electoral
fraud, theft of funds, and conflicts of interests. The state Senate passed
the bill unanimously in May; the state House already approved in late April a
similar measure, also unanimously.
